NOTICE OF RECEIPT OF THE PERMIT RENEWAL APPLICATION
FOR ARNOLD ENGINEERING DEVELOPMENT CENTER

Arnold Engineering Development Center (AEDC) submitted a Part A and Part B hazardous waste management permit application on May 25, 2004, to the Tennessee Department of Environment and Conservation’s (TDEC), Division of Solid Waste Management (DSWM), to renew its current permit (TNHW-054) to continue to store hazardous waste in containers at its facility at 100 Kindel Dr., Arnold Air Force Base TN, 37389-1228 (see map). This action follows the Pre-Application meeting conducted by the facility on April 20, 2004, as required by Tennessee Rule 1200-1-11-.07(2)(c)3(i). No comments were received at this meeting.

AEDC (EPA ID No.: TN8 57 002 4044) operates as a U. S. Air Force research and development facility engaged in the design and testing of aerospace systems. The test activities and associated support services result in the generation of a number of chemical wastes and by-products that are classified as hazardous wastes.

The current permit, issued on October 28, 1994, was effective for ten (10) years. This permit allowed the facility to continue to manage a maximum quantity of 57,420 gallons or 1,044 drums in Building 1456. Rooms 1001, 1002, 1003, and 1004 have a capacity of 9,900 gallons. Rooms 1006 and 1007 have a capacity of 8,900 gallons. Room 1007 may be used for storage of hazardous waste during high volume materials and may also be also utilized to store PCB waste as well as hazardous materials. The renewal application does not purpose any new storage capacity.

The permit renewal application also provides information on all solid waste management units (SWMUs) and Areas Of Concern (AOC) at the facility, including previous or ongoing investigations or corrective actions for all releases of hazardous wastes or hazardous constituents.

Tennessee Hazardous Waste Management Regulations require that the facility submit the permit renewal application before the current permit expires on November 28, 2004, thus enabling Arnold Engineering Development Center to continue to operate under the current permit until another permit is issued or denied. Renewal of this permit will allow Arnold Engineering Development Center to continue its operation for up to additional 10 years.

As set forth in Tennessee’s Hazardous Waste Management Regulations, a complete permit application, consisting of a Part A and a Part B, must include certain text, drawings and other information adequate to demonstrate that the facility will comply with the various technical, administrative and financial standards applicable to such a facility. Evaluation of the renewal application involves an in-depth review of the application materials by DSWM staff and subsequent correspondence between DSWM and the facility identifying and correcting any deficiencies in the submitted information. Once it determines the application is complete, DSWM will make a tentative decision to either grant or deny the permit and issue either a draft permit or a notice of intent to deny the permit. A draft permit would also include conditions regulating both the operational units, SWMUs and AOCs at the site. The latter conditions require that any future and existing SWMUs and AOCs be evaluated for potential releases and remediation, as necessary. Public Notice will be given of this tentative decision, and the public will have at least 45 days to submit written comments on the draft permit/proposed action. A public hearing, if requested, may also be held to receive public comments within this public comment period. After considering the public comments received and making any appropriate revisions, the DSWM director will issue a final permit decision (or a decision to deny the permit) and a response to comments.
