Notice of Receipt of the Permit Renewal Application for an
Existing Hazardous Waste Management Facility

Clean Harbors Tennessee, LLC, a commercial hazardous waste facility in Greenbrier, TN, submitted a Part A and Part B hazardous waste management permit renewal application on December 7, 2005 and March 20, 2006 respectively to the Tennessee Department of Environment and Conservation (TDEC), Division of Solid Waste Management (DSWM) to renew its current permit (TNHW-093) to continue to operate as an existing hazardous waste treatment and storage facility. Clean Harbors Tennessee, LLC, (hereinafter, “Clean Harbors”) (EPA ID Number TND 00 064 5770), is located at 2815 Old Greenbrier Pike, Greenbrier, Robertson County, TN 37073 (see Map). This action follows the Pre-Application meeting conducted by the facility on March 6, 2006, as required by Tennessee Rule 1200-1-11-.07(2)(c)3 (i). There were no comments received during the public comment period and during the public meeting.

This renewal application proposes the continued operation and maintenance of the hazardous waste container storage and treatment units. Clean Harbors receives hazardous wastes from a variety of sources including but not limited to: industries, institutions such as hospitals and universities, research and development facilities, government agencies, and emergency response or remedial action sites. Currently this permitted facility has 3 existing storage units, namely, the Warehouse, Trailer Containment Building, and Dock II; and a proposed unit which is the Bulking facility. The total storage capacity for the facility is 200,000 gallons which may be achieved through combinations of these permitted storage units. The treatment processes at this facility are Chemical Fixation, Blending, and Bulking. The total treatment capacity of 20,000 gallons/day is achieved individually or through combination of these processes.

The permit renewal application also provides information on all solid waste management units at the facility, including previous or ongoing investigations or corrective actions for all releases of hazardous wastes or hazardous constituents. Clean Harbors shall be required to investigate any releases of hazardous waste or hazardous constituents pursuant to this permit at the facility regardless of the time at which waste was placed in a unit and to take appropriate corrective action for any such releases.

The current permit (TNHW-093) was issued on September 20, 1996, and was effective for ten (10) years. Tennessee Hazardous Waste Management Regulations, Rule 1200-1-11, required that the facility submit the renewal application 180 days before the current permit was to expire on September 20, 2006; thus, enabling Clean Harbors to continue to operate under the current permit until a final decision is made. As set forth in Tennessee’s hazardous waste management regulations, a complete permit application, consisting of a Part A and a Part B, must include certain text, drawings, and other information adequate to demonstrate that the facility will comply with the various technical, administrative and financial standards applicable to such a facility. Evaluation of the renewal application involves an in-depth review of the application materials by DSWM staff and subsequent correspondence between DSWM and Clean Harbors identifying and correcting any deficiencies in the submitted information. Once it determines the application is complete, DSWM will make a tentative decision to either grant or deny the permit and issue either a draft permit or a notice of intent to deny the permit. Public notice will be given of this tentative decision, and the public will have at least 45 days to submit written comments on the proposed action. A formal public hearing may also be held to receive public comments within this public comment period. After considering the public comments received and making any appropriate revisions, the DSWM director will make a final decision and issue either a final permit or a permit denial to Clean Harbors and response to comments.

Copies of the Part A and Part B application are also available for public inspection during normal business hours, 8:00 a.m. to 4:30 p.m. Monday through Friday, except legal holidays, at the Nashville Environmental Assistance Center, Public Access Area, 711 R.
