NOTICE OF RECEIPT OF THE PERMIT RENEWAL APPLICATION
EASTMAN CHEMICAL COMPANY, TENNESSEE OPERATIONS

Eastman Chemical Company, Tennessee Operations (Eastman) submitted a Part A and Part B hazardous waste management permit application on March 29, 2005 to the Tennessee Department of Environment and Conservation’s (TDEC’s) Division of Solid Waste Management (DSWM) to renew its current permit (TNHW-086) to continue to store hazardous waste in containers and tanks at its facility located on Eastman Road in Kingsport, Sullivan County, Tennessee 37662. The Eastman facility is located approximately 2 miles north on John B. Dennis Highway (State Highway 93) from US Interstate 181. (See Map) This action follows the Pre-Application Public Meeting conducted by the facility on March 7, 2005, as required by Tennessee Rule 1200-1-11-.07(2)(c)3(i). Some questions were asked and answered during the meeting and documented in Section M of the permit reapplication.

Eastman is a privately owned facility that manufactures chemicals, fibers and plastics. It is composed of manufacturing areas including power and generation, water supply and maintenance, industrial landfills, a wastewater treatment plant, and buildings that provide administrative, engineering, research, sales, environmental, health and security, etc.

The current permit, issued on September 29, 1995, was effective for ten (10) years. This permit allowed the facility to store a maximum quantity of 179,920 gallons of hazardous waste in containers in eleven storage units (Buildings 213A-D, 267F, 248 [four units], 195Y, 285Y [two units], 133B and 259). The renewal application is for the continuance of eight of these container storage units (Buildings 213A-D, 248 [four units], 195Y, 285Y [one of the two units], and 259) with a maximum quantity of 116,880 gallons of hazardous wastes. The three container storage units not part of the renewal application will be closed under the existing permit. The current permit also allowed the facility to store a maximum quantity of 91,094 gallons of hazardous waste in seven tank storage units (Buildings 267Y [three units], 248 [four units]). The renewal application is for the continuance of four of these tank storage units (248 [four units]) with a maximum quantity of 78,224 gallons of hazardous wastes. Eastman is allowed under the existing permit, as purposed in the renewal application, to store hazardous waste in the container and tank storage units generated on-site and to receive and store hazardous waste generated off-site provided the hazardous waste generated off-site originated from material manufactured by Eastman and generated only at sites owned and operated by Eastman, subsidiaries of Eastman, or a product distribution sites under contract to Eastman. The volume of the hazardous waste received from such off-site sites and placed in storage for more than thirty (30) days does not exceed ten percent (10%) of the permitted storage capacity at Eastman.

Tennessee Hazardous Waste Management Regulations (Regulations) require that the facility submit the permit renewal application before the current permit expires on September 29, 2005, thus enabling Eastman to continue to operate under the current permit until another permit is issued or denied. Renewal of this permit will allow Eastman to continue its operation for an additional 10 years.

As set forth in the Regulations, a complete permit application, consisting of a Part A and a Part B, must include certain text, drawings and other information adequate to demonstrate that the facility will comply with the various technical and administrative standards applicable to such a facility. Evaluation of the renewal application involves an in-depth review of the application materials by DSWM staff and subsequent correspondence between DSWM and the facility identifying and correcting any deficiencies in the submitted information. Once it determines the application is complete, DSWM will make a tentative decision to either grant or deny the permit and issue either a draft permit or a notice of intent to deny the permit. Public Notice will be given of this tentative decision, and the public will have at least 45 days to submit written comments on the draft permit/proposed action. A public hearing, if requested, may also be held to receive public comments within this public comment period. After considering the public comments received and making any appropriate revisions, the DSWM director will issue a final permit decision to either issue a final permit or terminate the existing permit. A Response to Comments will also be issued at that time.
